Why offer customer storage insurance?

Most, if not all self storage rental agreements contain a clause stating that the facility is not responsible for the tenant’s goods in storage. The tenant reviews and then signs the rental agreement. Problem solved, right? Not exactly. Court rulings have determined that the facility can still be held liable for damage to the tenant’s contents, unless the facility offers an alternative option for coverage. By offering customer storage insurance to your tenants, you are reducing your facility’s liability exposure.

In a 2007 decision by the Third US Court of Appeals in the case of Kane v. U-Haul, the court found in favor of the facility because they offered customer storage insurance to their customers. One tenant had chosen coverage, and was able to collect the amount of the coverage they selected. The other tenant refused the coverage, and the court ruled that the facility was not responsible for the damage to that tenant’s goods since coverage was offered and not accepted by the tenant.

Under the SafeStor programs, each tenant signs an additional one page addendum, where they choose or decline the coverage. If the tenant chooses SafeStor and a loss occurs, direct the tenant to contact us to file a claim. If the tenant declines coverage, the facility copy of the addendum serves to reduce your business liability in the event of a loss, by showing that you did make coverage available, and it was declined by the tenant.
